First Amendment

Freedom of Speech

Schenk v. US (espionage act, congress shall not make any law who goes against the first amendment)

Brandenburg v. Ohio (said black people should be sent back to Africa, you cannot teach nor reflect something bad to society although you have freedom of speech)

Freedom of Press

New York Times v. Nixon (department of defense in Vietnam war)

Branzburg v Hayes (excessive use of marihuana in Kentucky, branzburg refuse to reveal its source so they out him in jail)

Freedom of Religion

Cora McRave v. Patricia R. Harris (abortion, she does not belong to any religion and between her believes it was seen abortion as something correct.)

Sebelius v. Hobby Lobby( do not promote contraceptive methods nor the abortion, goes against "Obama healthcare" plan because of their religion)

Torcaso v. Watkins(in order to make some papers in Maryland he had to declare his religion but he was atheist)

Sherbert v. Verner( Adventist who could not get job because of his religion he was not able to work on Saturdays)

Amendment 2

Right to bear arms

USA v. Miller( he transported unregistered shotguns and got caught and he tried to defend himself being supported with the second amendment, however several shotguns does not infer whether you are protected or not; it is more about trafficking guns)

Plesser v. Illinois(walking on streets with arms with the intention of start fight, caught, defended by 2 amendment but lost the case)

District if Columbia v. Heller (established firearms gun)

Amendment 3

No quartering of soldiers

This just will happen if USA will get invaded

Amendment 4

Must have warrant search and seizures

Teddy v. Ohio (dudes suspicious)

Welles v. Florida (drunk driving

Amendment 5

You don't have to testify against yourself,

Miranda v. Arizona ( Ernesto was arrested by kidnapping and robbery, confessed however he didn't know about his rights so he appealed and won the case)

Hurtado v. California (killed his wife and do not testify (does not have to much sense in this case))

Amendment 6

Right to a speedy trial and lawyer, being told

Escoledo v. Illinois ( someone testify against him, he did not really know about his rights just about having a lawyer )

Barker v. Wingo ( wingo testified against the barker because both were tried with murder, he asked for a trial, national court have set duration so that's how he won the case by violating the period of time settled)

Shepard v. Maxwell( s accused by killing his wife, he had a trial and he lost but he rejected he didn't have a fair trial because lots of news were in the trial and can be even made some influence in the jury. He claimed he fought to the person who killed his wife)**

Amendment 7

Right to a jury trial (fair trial)

Two types:

Grand trial

Petit trial

Amendment 8

Right to complain about unusual punishment
