APROXIMACIÓN A UN SISTEMA TRIBUTARIO AMBIENTAL EN COLOMBIA

RESUMEN: El sistema tributario colombiano posee una serie de figuras fiscales enfocadas al cuidado del medio ambiente, la normatividad es dispersa y presenta dificultades en la conformación de lo que esté trabajo a catalogado como la aproximación al sistema tributario ambiental en el país. La experiencia internacional presenta los diferentes mecanismos (incentivos o impuestos tributarios), utilizados como políticas públicas empleadas en la conservación y protección del medio ambiente, en general los sistemas tributarios latinoamericanos contiene algunas figuras tributarias ambientales pero se evidencia la complejidad y la deficiente efectividad de estas medidas, las cuales han sido complementadas por normas sancionatorias a las actividades contaminantes; para mejorar el diseño de los impuestos ambientales en el sistema tributario colombiano hay que realizar una evaluación exhaustiva de modelo económico y el impacto en las actividades generadoras de renta y su efecto en el cuidado y preservación del medio ambiente.

ABSTRACT: The tributary(tax) Colombian system owns a serie of fiscal figures focused on the care of the environment, the law is dispersed and presents difficulties in the conformation of what this task has to catalogued as the approximation to the tributary(tax) environmental system in the country. The international experience presents the different mechanisms (incentives or tributary(tax) taxes), used as public policies in the conservation and protection of the environment, overall the tributary(tax) Latin-American systems it he, contains some tributary(tax) environmental figures but the complexity and the deficient efectiveness is shown, Which one of has been complemented by sanction procedurestor the pollutant activities; to improve the design of the environmental taxes in the tributary(tax) Colombian system it is necessary to do an exhaustive evaluation of economic model and the impact in the generating activities of revenue and his or her, effect in the care and preservation of the environment.
