According to the website “findlaw.com” a personal injury case can be explain as “legal disputes that arise when one person suffers harm from an accident or injury, and someone else might be legally responsible for that harm”. In this order of ideas, this type of cases can become formalized through civil court proceedings or can be resolved through informal settlements between the two parts before the lawsuit is filed. This agreement depends on the result that the victim wants to obtain: either find others legally at fault or solve the problem through dialogue. It is important to report a personal injury because then you can find the correct way to compensate physical pain and suffering. And in addition, you may receive damages for any physical disfigurement or disability that resulted from your injury.

The first step that you need to follow if you are a victim of personal injuries is to find an attorney who could guide you correctly and guard over your interests. According to the answer company Thomson Reuters the first way to solve your problem and get effective justice is to file a formal lawsuit. Which happens when “the plaintiff” files a civil "complaint" against another person, business, corporation, or government agency (the "defendant"), alleging that they acted carelessly or irresponsibly in connection with an accident or injury that caused harm”. Also, The American Bar Association specifies in their web page “if you win, a judge or jury award you money, known as damages, for your injuries. That amount can include compensation for such expenses as medical bills and lost wages, as well as compensation for future wage losses”.

However, there are moments when the victim does not want to go to trial, this requires the most common way to solve disputes: an Informal Settlement. According to the law firm Simmons, Hanly, Conroy  “a settlement commonly takes the form of negotiation, followed by a written agreement in which both sides forgot any further action (such as a lawsuit), choosing instead to resolve the matter through payment of an agreeable amount of money”. By using this alternative a person can avoid the stress of a long trial and find quick but effective solutions with the help of their insurers and the attorneys that are representing both sides.

It is important to take into account the Statute of Limitations, which means that plaintiffs have a limited time in which to file a lawsuit. Being more specific, the web page LawTeacher.net “the period of time dictated by a statute of limitations begins when the plaintiff is injured or discovers the injury, and are established by state law and often vary by type of injury”. Which means that it can vary from state to state.

Finally, I want to end up this essay by making and invitation to all those people who are victims of personal injuries in their homes, places of work, schools, colleges, etc. In order to make them report these violations to their dignity and to their bodies, because is not fair to remain quiet when this heinous crimes happen. It is time for us to seek for justice through a legal system, no through violence and to stop allowing that these terrible acts keep on happening in our society unpunished.
