CYBERCRIME

Computer crimes are behaviors in which criminals use computer programs to commit infractions such as virus implantation, website impersonation, scams, copyright infringement, piracy, among others.


In the Colombian law, more precisely in the Penal Code Law 599 of 2000 are characterized in several of its articles the most common offenses derived from the computer science, and are reflected in its article 269. Taking into account that we emphasize the aggravating that they could be made in them.

On January 5, 2009, the Congress of the Republic of Colombia promulgated Law 1273 "By means of which the Penal Code is modified, a new protected legal good is created - denominated" Of the Protection of the information and of the data " - and systems that use information and communication technologies, among other provisions, are fully preserved ".

This law classified as crimes a series of behaviors related to the handling of personal data, so it is of great importance that companies are legally shielded to avoid incurring any of these criminal offenses.

We must not forget that technological advances and their use to illegally take over the assets of third parties through the cloning of bank cards, infringement and alteration of computer systems to receive services and electronic funds transfers through manipulation of programs and Affectation of ATMs, among others, are increasingly common behaviors in all parts of the world. According to the magazine Cara y Sello, during 2007 in Colombia, companies lost more than 6.6 billion pesos as a result of cybercrime.

The sophistication of the use and strategy of Information Technology entails the need and obligation to improve security tools. Throughout the world, cyber-attacks have increased with innovative methods. In Colombia, security institutions are linking to the IT Strategy to increase the State's capacity to confront cyber threats, since at the moment it presents great weaknesses, despite the existence of governmental, private and civil society initiatives that seek to counteract its effects, there is no appropriate inter-institutional coordination. In 2011 in Colombia there were more than 550 successful attacks on state entities, for 2013 the attacks were reduced to +130.


Taking into account these figures and problems, they lead us to think what would be the obstacles faced by the actors at this moment, as a first step I would say that security attacks are the order of the day, since they are multiple and varied from different areas, both criminal organizations and ordinary people or the so-called hackers, this coupled with a low response capacity, which in my concept comes from two points, one is the adequate training of staff to counter such attacks and the other, the lack of economic investment for this scourge, however it should be noted that from the high officials of the Colombian public power, including the Ministry of Information and Communication Technologies, have tried to lower the commission rates for these crimes, not yet enough, we as civil and legal persons of this country, we must generate sufficient trust both in the entities and in the the Colombian state to cope with and in the near future eradicate such crimes.
