THE FRENCH REVOLUTION

Although reading is somewhat complex can be understood immediately that the French Revolution breaks the historicist model where a minority is privileged social group and from this moment we can talk about contemporary times. The main topic on tata Declaration of Human Rights which appear in response to the abuses of absolute state whose excess of power led to a series of question about the origin of the authorities , thus substituting the idea of divine origin by consensus pact . I think this is more relevant when taking the combined individualistic to a lesser extent statist inputting which is the social contract which thus became the source of political participation rights , which culminated years later with universal suffrage. We know that at the time the need to limit the power , as a general problem and what will rise to the overall justification of human rights to be considered at the outset and until the late nineteenth century as rights of non-interference in a reserved area to free action of individuals. The reason of the covenant or social contract is then a defense of those "natural rights" that limited the power of the state.

It is remarkable that these rights came to be universal in scope but also met some opposition from varied and contradictory ideological , political and religious approaches. Achieved , however, reach the end of the twentieth century thanks to a triple evolution through three processes: positivization , generalization and internationalization . By the first process , natural rights were incorporated into positive law , becoming the disciplinary apparatus protected by the sovereign power in case of violation . This dimension is normally produced in the highest area of the law which is the Constitution , although in some cases the development rights to be extended with the law. This first process of the evolution of human rights highlighted the mediating role of the sovereign political power in this positivization , because the law is directly or indirectly state law . Eye, it is noteworthy that in reading mentioned that in spite of this the power of the monarch was not absolutely barred on these new representations , as the abosluto character of veto to the will of the monarch became necessary to produce the ultimate source of law, the monarch was thus exercised from outside the assembly as chief executive of the private self of almost all regulatory powers .

In the French Declaration of 1789 stated that men are born and remain free and equal in rights. However , reading suggests that the reality was very different back then . The enjoyment of the rights was limited to those who had sufficient economic and cultural level to avoid having to deal with survival. They were therefore actually picture of the bourgeoisie. The working class and the modest artisans remained aloof. Therefore states that the weak point of the revolution is in the same guarantee of rights. Warranty that is linked to a constitution which is able to impose itself as such.

The contemplation of reality and the affirmation of freedom and equality for all men will thus be at the origin of the process of generalization to explain the evolution of human rights to this day. The struggle for the realization of the ideals of freedom and equality was long and costly , with repression , suffering and death
