OBJETIVOS GENERALES

Atreves de esta investigación pretendemos tener un resultado de un conocimiento más amplio sobre nuestro tema principal las “obligaciones complejas , clasificación de las obligaciones por razón de la prestación “ y saber identificar los subtemas de acuerdo a cada tema tratado durante la investigación , es importante recalcar que los temas tratados en este documento están basados en previas investigaciones y respaldadas verídicamente para que el lector tenga una mejor compresión y pueda facilitar la comprensión de la misma , ya que de nada sirve llevar una investigación a cabo sin antes investigar dicho tema central y no proporcionar la fuente donde la pudimos haber sacado , ya que sabemos y tenemos el conocimiento que existen diversas páginas de internet donde la fuente y la información no es veraz y pueden subir cualquier cosa a su conveniencia sin importar que el lector no tenga el suficiente conocimiento y sin importar el daño que puede provocar esto , sin embargo me di a la tarea de investigar previamente los temas y subtemas para poder desarrollar mejor el documento y que esta investigación sea satisfactoria para el lector y gente que tengas interés en dicho documento , temas , subtemas tratados en esta investigación.

INTRODUCCION

no necesariamente necesitas ser un aprendiz de la abogacía para tener algún interés por leer el documento pero acaso te has preguntado que alguna vez lo has ejercido sin darte cuenta y que desde el momento que tu vendes algo y otra persona se hace responsable ya tienes dichas obligaciones jurídicas que cumplir tanto tu como acreedor de dar la cosa y el deudor de hacer dicho pago de la cosa , a partir de ese momento adquieres ciertas obligaciones con el deudor o acreedor , pero la invitación es abierta para que conozcas más a fondo los temas que trataremos en esta obligación si eres comerciante , si eres una persona activa en el mercado o eres una persona que alguna vez ha vendido algo tienes que informarte más de este tema para tener dicho conocimiento que obligación puedes y has hecho cumplir en un futuro y como persona que ejerce la abogacía como su carrera y su profesión tienes que tener el criterio para informarte sobre los temas relacionados con la abogacía .

Las Obligaciones complejas o también llamadas de objeto plural u objetivamente complejas que es nuestro tema principal , son el vínculo jurídico que en virtud del cual la persona llamada deudor está obligada a dar otra llamada acreedor, una cosa, o a realizar un hecho positivo o negativo. Así el sujeto activo de la relación puede exigir al obligado (deudor) el cumplimiento de lo pactado.

A su vez podemos entender que dichas obligaciones se pueden dividir en tres tipos:

a)Conjuntivas

b)Facultativas

c)Alternativas

Cada una tiene su propia estructura y definición el particular que se verán a continuación a la brevedad posible conforme nosotros vallamos avanzando en la investigación .

Como subtemas que trataremos en la investigación tenemos también las obligaciones dentro del tema de obligaciones complejas por la pluralidad de sujetos .

a) Obligaciones simplemente mancomunadas

b) Obligaciones solidarias

c) Obligaciones indivisibles

Son temas relevantes y de importancia para el derecho civil ya que de ai nace una obligación y de la obligación se hace un deudor y un acreedor y se va haciendo una cadena y un sinfín de obligaciones las cuales se vea la posibilidad de ver la mejor manera de encontrar una solución al problema para eso podemos señalar algunas obligaciones como la de

a) Obligaciones de dar cosa cierta

b) Obligaciones de dar una especie determinada

c) Obligaciones de dar dinero

d) Obligaciones de hacer y no hacer

Son los temas a tratar dentro de esta investigación que lo iré desarrollando con su tema y subtema para una comprensión fácil para el lector.
